According to Decree 152/2020/NĐ-CP on December 30th, 2020 about foreign employees who are working in Vietnam and recruitment, management local employees who are working for foreign enterprises in Vietnam.

To implement in accordance with the law of report on using foreign employee, Department of Labour, War invalids and Social affairs (Labor department) require enterprises to do the following:

1. Prepare and submit report on using foreign employee for the periods: 6 months and yearly.

- Form of report: Form 07/PLI - Annex I, Decree 152/2020/NĐ-CP.

- Time for submission:

• 6-months report: Timeline of data collection from December 15 of the previous year to June 14 of the reporting period. Time for submission: From 15/06 to 04/07.
• Yearly report: Timeline of data collection from December 15 of the previous year 14/12 of the reporting period. Time for submission: From 15/12 to 05/01 of the following year.

 - Method of submission: Enterprises submit Labor Department (Employment - occupational safety department) online, by:

• Scan the QR code to access the link.

Note: Online-submitted report must included general information, scan of report which is signed and stamp (PDF file) and soft copy (word or excel) for the convenience of data collection.

2. Information about the working status of foreign employees regarding to the Article 14, Circular 01/2022/TT-BLĐTBXH

- Form of information providing: Form 03 of the annex attached to the Circular 01/2022/TT-BLĐTBXH. 

- Responsibility for declaration:  Foreign employees declare the information of form 03 by themselves. In case the foreigners cannot process, the employer shall process on behalf.

 - Method of submission: Enterprises, individuals access to the link: https://forms.gle/haXiymPeuKLeGQPx8  or scan QR code to declare the information online.

 - Time for submission: From 01/06 to 30/06.

After the about stipulated timeline, Labor department will not accept any reports submitted by enterprises or individuals;  

At the same time, consider as a basis to confirm the observance of legal regulations at the request of State in order not to violate Article 32 of the Government's Decree No. 12/2022/ND-CP dated January 17, 2022 on sanctioning of administrative violations in the field of labor, social insurance and Vietnamese employees who working abroad under contract.
